Direito à saúde no período da pandemia e a judicialização frente ao poder público

RESUMO: O direito à saúde é considerado um direito fundamental social, garantido pelo Estado Democrático de Direito. No entanto, a pandemia da COVID-19 trouxe consigo um conjunto de desafios para assegura-lo. Nesse sentido, o objetivo deste artigo é analisar o papel do Estado como responsável pelo direito à saúde, a judicialização como ferramenta para assevera-lo, e os seus desdobramentos durante o período pandêmico. Assim, visa demonstrar que a judicialização é uma ferramenta importante para preservar o direito à saúde no Brasil durante a pandemia da COVID-19, já que esta serve como meio para suprir a lacuna na efetivação desse direito e como estratégia para defesa dos direitos fundamentais. Para tanto, metodologicamente, a pesquisa será realizada por meio de uma abordagem bibliográfica, de modo que serão considerados os aspectos históricos, a Teoria da Reserva do Possível e a importância da judicialização para a efetivação desse direito. Assim, se dará a partir de uma revisão bibliográfica, com dados reportados por meio de doutrinas, livros e artigos já publicados sobre o tema.

ABSTRACT: The right to health is considered a fundamental social right, guaranteed by the Democratic State of Law. However, the COVID-19 pandemic brought with it a set of challenges to the guarantee of this fundamental right. Therefore, the objective of this article is to analyze the role of the State as guarantor of the right to health, judicialization as a tool to guarantee this right and the developments of this right in the COVID-19 pandemic. The analysis will be carried out through a bibliographical approach, taking into account the historical aspects, the theory of the reserve of the possible and the importance of judicialization for the effective realization of this right. The work aims to demonstrate that judicialization is an important tool for the guarantee of the right to health in Brazil in the COVID-19 pandemic, serving as a means to fill the gap in the effective realization of this right and as a strategy for defending fundamental rights. This work is carried out through a bibliographical review, with data reported through doctrines, books and articles already published on the subject.
